Information We Collect

We collect your personally identifiable information ("PII") when you submit a request form on the Site to be matched with Service Providers. We may also collect your PII when you otherwise agree to the terms of this Privacy Policy but do not complete the applicable form in full. The types of PII that we collect at the Site include, without limitation: (a) your first name; (b) your last name; (c) your telephone number; (d) your e-mail address; (e) your ZIP code and, where requested, your street address, city and state; (f) details about the insurance coverage you are requesting quotes for, such as the type of coverage, the vehicle or property to be insured, the date of birth, gender and marital status of the people to be covered, whether you own your home, your current insurance status and history, and whether there have been recent accidents, violations or claims; and (g) any and all other information that you choose to submit on the applicable form. If the information you have provided changes and you still wish us to have such information, we request that you contact us promptly so that we can update our records accordingly.

We also automatically collect certain information when you visit and interact with the Site, including, without limitation: (i) your IP address and IP address history; (ii) device information such as your browser type, user agent, operating system and the domain name of your Internet service provider; (iii) usage data such as the pages you visit, the forms you complete and the date and time of your visit; and (iv) the marketing parameters associated with your visit, such as the referring website, the landing page you arrived on and any campaign, source, medium or tracking identifiers contained in the web address.

In addition, when you submit a form on the Site, we capture proof of your consent to be contacted through independent third-party compliance services, including TrustedForm (a service of ActiveProspect, Inc.) and Jornaya LeadiD (a service of Lead Intelligence, Inc.). These services create a certificate and/or a digital record of your visit, which may include the form you completed, the disclosures that were present on the page at the time of completion, the type of consent you provided, your IP address, device information and a visual playback of your interaction with the form. We also retain the exact text of the consent disclosure that was displayed to you and the web address of the form you submitted. We retain these compliance records as evidence of your prior express written consent to be contacted by us and/or our Marketing Partners, including in the event of any question or dispute regarding such consent.

We do not ask for, and you should not submit, information such as your Social Security number, driver's license number, financial account numbers, or health or medical information. We do not knowingly collect this information through the Site.

How We Use Your Information

By submitting your PII on the Site, you agree that we may use and share such PII in order to: (a) match you with, and transmit your PII to, one or more Service Providers so that they may contact you about their products and services; (b) respond to your inquiries and provide customer service; (c) send you marketing communications, where and to the extent permitted by applicable law; (d) maintain records evidencing your consent to be contacted; (e) operate, analyze, improve and personalize the Site and our services; and (f) comply with applicable legal obligations. Any PII that you supply to any Service Provider shall be governed by the applicable Service Provider's own privacy policy. Please be advised that InsureCompareNow.com does not itself provide insurance or any related products and services. Your eligibility for coverage and the ultimate terms, pricing and conditions of any policy or service provided by any Service Provider will be determined by that Service Provider.

Sharing and Sale of Your Information

When you submit your PII on the Site, we share your PII with, and may sell your PII to, our Marketing Partners so that they may contact you by telephone, text message and/or e-mail regarding insurance products and services. We may be compensated by the Service Providers and partners we connect you with. This sharing may constitute a "sale" or "sharing" of personal information under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, "CCPA"), and under other state consumer privacy laws. A current list of our Marketing Partners is available at our Partner List page. You may opt out of the sale or sharing of your personal information by completing the form on our Privacy Rights Request Page.

We may also employ other companies and individuals to perform certain functions on our behalf. Examples include using companies and/or individuals to send direct and electronic mail, remove duplicate information from user lists, analyze data, provide marketing analysis, and create and store compliance records (including a visual playback of your contact with the Site) for quality assurance and training purposes and/or in the event of any question or dispute about you providing prior express written consent to be contacted by us and/or a Marketing Partner. The agents performing these limited functions on our behalf shall have access to our users' PII if and as needed to perform their functions for us, but we do not permit them to use your PII for other purposes.

We also reserve the right to release current or past user PII in the event that we believe that the user is using, or has used, our services and/or the Site: (i) in violation of the Site's Terms and Conditions, this Privacy Policy or any other of our operating rules or policies; (ii) to commit unlawful acts; (iii) if such PII is subpoenaed or requested pursuant to a judicial or regulatory proceeding or inquiry; (iv) if we are sold, merge with a third party, are acquired or are the subject of bankruptcy proceedings; provided, however, that if InsureCompareNow.com is involved in a bankruptcy proceeding, merger, acquisition or sale of all or a portion of its assets, you will be notified via e-mail and/or a prominent notice on the Site of any change in ownership or uses of your PII, as well as any choices that you may have regarding your PII; and/or (v) when we deem it necessary or appropriate including, without limitation, sharing your e-mail address with other third parties for suppression purposes in compliance with the CAN-SPAM Act of 2003, as amended from time to time, and Federal Trade Commission implementing regulations.

Telephone and Text Message Contact

By registering at the Site, you agree that such act constitutes an inquiry and/or application for purposes of the Amended Telemarketing Sales Rule (16 CFR 310 et seq.), as amended from time to time (the "Rule") and applicable state do-not-call regulations. As such, notwithstanding that your telephone number may be listed on the Federal Trade Commission's Do-Not-Call List, and/or on applicable state do-not-call lists, we retain the right to contact you via telemarketing in accordance with the Rule and applicable state do-not-call regulations.

In addition, where you provide your prior express written consent on the applicable form, you agree to receive marketing calls and text messages, including calls and messages placed using an automatic telephone dialing system, artificial voice or pre-recorded messages, from us and/or our Marketing Partners (where, and to the extent that, such marketing is permitted by applicable law). Your consent is not a condition of any purchase. You may revoke your consent at any time by completing the form on our Revoke Consent page or by contacting us using one of the methods set forth in the Contact section below.

We will not use or share your PII other than as described in this Privacy Policy unless you tell us that we can in writing. If you tell us we can, you may change your mind at any time. Let us know in writing if you change your mind by using any of the designated methods for contacting us set forth in the Contact section below.

A Cookie is a piece of data stored on your hard drive containing non-personally identifiable information about you. Cookies have many benefits to enhance your experience at the Site. To disable and reject certain Cookies, follow the instructions associated with your Internet browser. Even in the case where a user rejects a Cookie, he or she may still use the Site. We use this information to compile reports and to help us improve the Site. You can opt out of Google Analytics by installing the Google Analytics opt-out browser add-on or by adjusting your cookie settings.

The Site also uses the Meta (Facebook) pixel and related advertising tools to measure the effectiveness of our advertising and to serve ads to previous visitors to the Site on Meta platforms and elsewhere. We may also use remarketing services, such as Google advertising services, to advertise on third party websites to previous visitors to the Site. Third-party vendors, including Google and Meta, use Cookies and similar technologies to serve ads based on a user's past visits to the Site. Any data collected will be used in accordance with this Privacy Policy and the applicable third party's own privacy policy. You can set preferences for how Google advertises to you using the Google Ad Preferences page, manage your ad preferences in your Meta account settings, and opt out of interest-based advertising by using your browser's cookie settings or an industry opt-out tool. To the greatest extent permissible under applicable law, we are not responsible for the tracking practices of third parties in connection with the Site.

InsureCompareNow.com provides its users with the opportunity to receive special offers, products and/or services from third parties. Where you indicate the desire to receive certain offers, products or services from a third party during the applicable information collection process, the PII that was provided during that InsureCompareNow.com information collection process will be shared with the applicable third party so that such third party may provide their product or service to you and so that you do not have to complete another information collection form to purchase or receive that product or service.

We retain your PII, and the compliance records described above, for as long as reasonably necessary to fulfill the purposes described in this Privacy Policy, including to maintain evidence of your consent to be contacted, to comply with our legal, regulatory, accounting and reporting obligations, and to establish or defend legal claims. When your PII is no longer needed for these purposes, we will delete it or de-identify it in accordance with applicable law.
